1) Acceptance
These Terms of Use (“Terms”) govern your access to and use of the Cravri application and related services (the “Service”), provided by Cravri Team (“Cravri,” “we,” “us,” or “our”).
By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
2) Eligibility (17+)
The Service is intended for users age 17 and older. By using the Service, you represent that you are at least 17 years old and have the legal capacity to enter into these Terms.
3) Your Account
- You may need to create an account and provide info such as name, username, and email.
- You are responsible for maintaining confidentiality of your credentials and for all activity under your account.
- You agree to provide accurate information and keep it up to date.
4) The Service and AI-Generated Content
Cravri helps you create fun and engaging face-swap emojis and GIFs using advanced AI technology. You may upload photos/images and/or provide text prompts to generate content.
The Service may produce results that are unexpected, inaccurate, or offensive depending on your inputs. You are responsible for how you use and share outputs.
5) User Content
5.1 Your content
“User Content” includes content you submit to the Service, such as photos/images, text prompts, and support messages. You retain ownership of your User Content as between you and Cravri.
5.2 License you grant to us
You grant Cravri a limited, non-exclusive, worldwide, royalty-free license to host, store, process, reproduce, and transmit your User Content solely to operate the Service, generate requested outputs, provide support, comply with law, and enforce these Terms.
5.3 You must have rights to what you upload
You represent and warrant that you have all rights necessary to submit User Content and that it does not violate any law or third-party rights (including privacy, publicity, copyright, or trademark).
6) Prohibited Conduct
- Illegal, harmful, or abusive activity.
- Uploading or generating unlawful content, including any sexually explicit content involving minors.
- Impersonation or misrepresentation of identity.
- Bypassing security, reverse engineering, or disrupting the Service.
- Creating or distributing content that violates others’ privacy or rights (including non-consensual intimate imagery).
- Scraping, harvesting, or collecting information except as permitted by law.
We may remove content, restrict access, or suspend/terminate accounts to enforce these Terms.
7) Intellectual Property
The Service and its content (software, design, text, graphics, trademarks) are owned by or licensed to Cravri and are protected by applicable laws. Except for the limited rights expressly granted, we reserve all rights.
8) Third-Party Services
The Service may interact with third-party platforms (for example, if you choose to share outputs). Your use of third-party services is governed by their terms and policies, and Cravri is not responsible for them.
9) App Store Additional Terms (Apple)
- These Terms are between you and Cravri, not Apple.
- Apple has no obligation to provide maintenance or support for the Service.
- To the maximum extent permitted by law, Apple is not responsible for claims relating to the Service.
10) Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, CRAVRI DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
11) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CRAVRI WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CRAVRI’S TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID (IF ANY) TO USE THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
12) Indemnification
You agree to indemnify and hold harmless Cravri from claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Service or violation of these Terms or applicable law.
13) Termination
You may stop using the Service at any time. We may suspend or terminate your access if we reasonably believe you violated these Terms, pose a risk, or for operational or legal reasons. Provisions that should survive will survive termination.
14) Governing Law and Dispute Resolution (Binding Arbitration)
These Terms are governed by the laws of Cravri Team’s principal place of business, without regard to conflict of laws rules.
Any dispute arising out of or relating to these Terms or the Service will be resolved by binding arbitration, except that either party may seek injunctive or equitable relief to prevent unauthorized use or infringement of intellectual property or to protect rights pending arbitration.
The arbitration will be conducted by a neutral arbitrator and will be final and binding. Each party will bear its own costs unless the arbitrator awards otherwise under applicable law.
15) Changes to These Terms
We may update these Terms from time to time. We will post updated Terms and revise the Effective Date. Continued use after the Effective Date means you accept the updated Terms to the extent permitted by law.
